1. Agreement to These Terms
These Terms of Service (“Terms”) govern your access to and use of the Nous Fire website at https://www.nousfire.com/ and your purchase of a Nous Fire Constellation entry.
In these Terms, “Nous Fire,” “we,” “us,” and “our” refer to the operator of the Nous Fire website and service. “You” and “participant” refer to an individual accessing the website or purchasing an entry.
By accessing the website, submitting an entry, or purchasing the service, you agree to these Terms and the applicable Privacy Policy.
If you do not agree to these Terms, do not purchase or submit an entry.
2. Eligibility
The service is intended for individuals who:
Are at least 18 years of age.
Are located in the United States and eligible to use the service.
Provide accurate information reasonably necessary to process their entry.
Have the authority to submit any photograph or other information they provide.
By purchasing an entry, you confirm that you meet these eligibility requirements.
3. Description of the Service
Nous Fire offers a spiritual and philosophical practice called the Constellation.
The service involves a collective practice conducted by the practitioner within the Nous Fire framework. Participants submit a crown photograph and select one primary personal intention as part of the entry process.
A facial photograph is not required. Participants do not need to attend a live call, make an appointment, meditate on camera, or own a virtual-reality headset.
The service is spiritual and philosophical in nature. It is not healthcare, psychotherapy, medical treatment, psychological counseling, or a substitute for professional care.
4. Entry Price and Payment
The published price for a single Constellation entry is $25 USD, subject to any price clearly disclosed before you complete your purchase.
An entry is a one-time purchase. It is not a recurring subscription, and no recurring charge is authorized by these Terms.
Payment must be successfully completed through the payment method and checkout process provided on the website.
Any applicable taxes or additional charges will be disclosed as required by law before purchase.
If a displayed price differs between the website and checkout, contact us before completing the transaction so that the amount payable can be clarified.
5. What Your Purchase Includes
A single Constellation entry includes:
One entry into the applicable scheduled Constellation practice.
Submission of one crown photograph.
Selection of one primary intention.
An email completion record after the practice has been completed.
The completion record documents the administrative completion of the relevant practice according to the Nous Fire process.
It is not an independent scientific verification of spiritual activity, a guarantee that an intention will manifest, or certification of a personal, medical, emotional, financial, or material outcome.
Additional services or deliverables are not included unless expressly stated at the time of purchase.
6. Submission Requirements
To submit an entry, you must provide the information and materials requested in the entry form.
You are responsible for ensuring that:
Your email address is accurate and accessible.
Your photograph meets the submission instructions.
You have the right to submit the photograph.
Your selected intention is your own choice and does not unlawfully infringe another person's rights.
Your submission does not contain unlawful content or unnecessary sensitive personal information.
You are not required to explain the personal circumstances behind your intention.
Nous Fire may contact you if information required to administer your entry is missing or unusable. Where a submission cannot be processed, we will address the situation in accordance with these Terms and applicable law.
7. Saturday Schedule and Submission Cutoff
The published weekly intake cutoff is Saturday at 6:00 PM Central Time.
An entry must be successfully submitted and paid for in accordance with the instructions displayed on the website.
The applicable practice date and submission status should be determined by the schedule and confirmation provided during the actual entry process.
Entries received after the cutoff: Any registration completed after 6:00 PM Central Time will be assigned to the following Saturday's session.
We may need to adjust a scheduled practice because of technical difficulties, illness, emergencies, or other circumstances that prevent the service from being conducted as planned. If a material change affects your entry, we will communicate the applicable arrangements and any available remedy in accordance with these Terms and applicable law.
8. Completion Records and Email Delivery
Nous Fire sends the completion record to the email address submitted with your entry after the relevant practice has been completed.
You are responsible for providing an accurate email address and checking your spam, junk, and other filtered folders.
If you do not receive the expected completion email within the stated timeframe, contact contact@nousfire.com.
Expected Delivery Timeframe: Your completion email will be sent within 24 hours of your assigned Saturday Constellation session.
Email delivery may be affected by factors outside our control, including third-party email filtering, service interruptions, or incorrect contact details. We will make reasonable efforts to address delivery issues brought to our attention.
9. Nature of the Practice and No Guaranteed Outcomes
Nous Fire provides a spiritual and philosophical practice.
We do not guarantee that participation will produce any particular spiritual experience, emotional change, physical effect, healing, manifestation, relationship outcome, financial result, or other personal outcome.
Individual beliefs, interpretations, and experiences may differ.
The purchase is for the defined entry and associated service described in these Terms, not a promise that your selected intention will be fulfilled.
Nothing on the website should be interpreted as a claim that the practice diagnoses, treats, cures, or prevents any medical or mental health condition.
You should seek qualified professional assistance for medical, mental health, legal, financial, or other matters requiring professional advice.
10. Cancellation, Refunds, and Payment Disputes
Each Constellation entry is a one-time purchase.
All sales are final, except where a refund, cancellation, or other remedy is required by applicable law or expressly provided under these Terms.
If you submit an entry by mistake, need to report a duplicate charge, or believe that a payment was processed incorrectly, contact contact@nousfire.com promptly so that the matter can be reviewed.
If Nous Fire cannot provide a purchased entry and no alternative arrangement is agreed upon, we will provide any refund or other remedy required by applicable law.
Nothing in these Terms waives any non-waivable statutory consumer rights.
These Terms do not restrict your right to contact your payment provider or exercise any applicable legal rights.
11. Participant Privacy
Your submission may include a crown photograph, email address, selected intention, transaction-related information, and other details necessary to administer your entry.
Our handling of personal information is described in the Nous Fire Privacy Policy, available through the website.
By submitting information, you acknowledge that the information is provided for the purposes explained in that Policy. Where separate consent is legally required, that consent must be obtained separately.
You should not submit information you do not wish to share or information that is unnecessary for your participation.
12. Intellectual Property and Website Use
The Nous Fire name, branding, original website copy, visual materials, and other original content are owned by Nous Fire or used with permission, subject to applicable law.
You may access and use the website for personal, lawful purposes.
Unless permitted by law or authorized in writing, you may not reproduce, distribute, commercially exploit, or create derivative works from protected Nous Fire materials without the necessary permission.
Nothing in these Terms transfers ownership of Nous Fire intellectual property to a participant.
13. Prohibited Conduct
You agree not to:
Use the website for unlawful purposes.
Submit information or photographs you are not authorized to provide.
Attempt to compromise the website, payment process, or other technical systems.
Interfere with another person's use of the service.
Misrepresent your identity or eligibility.
Use the service in a way that violates applicable law or infringes the rights of others.
We may take reasonable action to protect the website, participants, and service integrity where misuse occurs, subject to applicable law and any obligations concerning payments or refunds.
14. Website Availability and Changes
We aim to maintain an accessible and functioning website but cannot guarantee uninterrupted or error-free operation.
Website features, scheduling, and service details may change as the service evolves. We will communicate material changes affecting an existing paid entry as appropriate and comply with applicable law.
Changes to future offerings or these Terms will not eliminate rights that have already accrued to you under applicable law.
15. Limitation of Liability
To the extent permitted by applicable law, Nous Fire is not responsible for indirect, incidental, special, consequential, or punitive losses arising from the use of the website or participation in the practice.
Nous Fire does not exclude or limit liability where doing so would be prohibited by law, including liability that cannot lawfully be waived or limited.
Nothing in these Terms guarantees a particular spiritual, emotional, personal, financial, or material result.
Any limitation of liability applies only to the extent permitted by the law governing the relevant claim.
16. Indemnification
To the extent permitted by applicable law, you agree to be responsible for claims, losses, or reasonable costs arising directly from your unlawful conduct, material violation of these Terms, or infringement of another person's rights in materials you submit.
This provision does not require you to indemnify Nous Fire for losses caused by Nous Fire's own unlawful conduct or waive any rights that cannot legally be waived.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Any dispute will be handled in accordance with applicable law. Nothing in this section removes any consumer right to bring a claim in a forum where applicable law requires that right to be preserved.
18. Severability
If a provision of these Terms is found to be unlawful, invalid, or unenforceable, the remaining provisions will remain effective to the extent permitted by law.
Any invalid provision will be interpreted or limited only as necessary to comply with applicable law.
19. Changes to These Terms
We may update these Terms when necessary to reflect changes in the service, business operations, or legal requirements.
The updated Terms will be published on this page with a revised “Last Updated” date. Where required by law, we will provide additional notice or obtain consent.
The Terms applicable to a particular purchase will be determined in accordance with applicable law and any required notice or consent concerning material changes.
